1. Scope & Acceptance

These Terms apply to Afrimode Commerce websites, mobile experiences, and services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility & Accounts

You must be of legal age to form a binding contract in your jurisdiction. You are responsible for the security of your account credentials and all activity under your account.

• Provide accurate, complete information.
• Notify us immediately of unauthorized use.
• We may suspend/terminate accounts for violations.

3. Orders, Pricing & Payments

Placing an order is an offer to buy. We may accept or reject at our discretion. Prices, promotions, and availability are subject to change without notice. Taxes, duties, and shipping may apply.

• Payment Methods: We accept the payment options shown at checkout. By submitting payment, you represent you’re authorized to use the method.
• Accuracy: We strive for accurate listings but errors may occur. We may cancel or adjust orders with incorrect pricing; if so, you’ll be contacted.
• Fraud: We may refuse or cancel orders suspected of fraud or abuse.

4. Shipping & Delivery

Estimated delivery windows are shown at checkout and in order confirmations. Delays can occur due to carrier capacity, customs inspection, or force majeure. Title and risk of loss pass to you upon delivery to the carrier unless required otherwise by law.

5. Returns & Refunds

Return eligibility, timelines, and conditions are described on our Returns Policy. Refunds are issued to the original payment method when applicable. Certain categories (e.g., perishable, personalized, final sale) may be non-returnable.

6. Acceptable Use

You agree not to misuse the Services. Prohibited actions include, without limitation:

• Interfering with security or access controls;
• Scraping, crawling, or harvesting data beyond fair use;
• Posting unlawful, infringing, deceptive, or harmful content;
• Reverse engineering or attempting to extract source code;
• Using the Services in violation of applicable laws or regulations.

7. Intellectual Property

All content on the Services — including text, graphics, logos, product imagery, videos, software, and UI — is owned by or licensed to Afrimode Commerce and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to access and use the Services for personal or internal business purposes.

Trademarks: Product and brand names are trademarks of their respective owners. No license to use any trademark is granted by these Terms.

8. Warranties & Disclaimers

Except as expressly stated, the Services and products are provided “as is” and “as available,” without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, Afrimode Commerce and its affiliates, officers, employees, and partners shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenue/data, arising from or related to your use of the Services.

In no event shall our aggregate liability exceed the greater of (a) the amount you paid in the 12 months prior to the claim, or (b) USD $100.

10. Indemnification

You agree to defend, indemnify, and hold harmless Afrimode Commerce from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms.

11. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data.

12. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction where Afrimode Commerce is established, without regard to conflict of laws. Disputes will be resolved in the courts of that venue unless otherwise required by consumer protection law.

Where permitted, you agree to resolve disputes individually (no class actions), and to first attempt informal resolution by notifying us at the address below.

13. Changes to Terms

We may update these Terms from time to time. Changes are effective when posted. If changes are material, we will provide reasonable notice.
